Maxen Technology Inc. provides cloud-based products and services (the “Service”, “Services”, “Application”) that aim at empowering building managers. Maxen Technology Inc. cares about the security of your information and uses commercially reasonable safeguards to preserve the integrity and security of all information collected through the Service.

Purpose and Scope of the Policy

This privacy policy describes how we collect, use and disclose your personal information and how this personal information can be consulted and corrected when necessary. For the purpose of our policies and procedures, “Maxen Connect”, the “Application” and the “Website” will be considered synonymous. This policy also explains how cookies are used on our Website.

By visiting any of our websites, accessing or using Maxen Connect, contacting us or agreeing to receive emails from Maxen Technology Inc., you accept the terms and conditions of this policy.

This policy does not extend to websites operated by third parties. Maxen Technology Inc. is therefore not liable for their privacy policies, procedures and practices.

Personal Information Collected

A. Information that you send us

​

We collect your personal information in several ways, including when you create an account on Maxen Connect, use any feature of our Software-as-a-service (“SaaS”) offering, use our online support services, contact us by telephone or by email, post on our social media accounts and complete forms on our Website.

Depending on the circumstances, personal information may include, but is not limited to, your name, contact information (street address, electronic address, telephone number), your job title, and your financial information (such as your method of payment).

If you are in the European Union, we are required to ensure that appropriate safeguards are in place prior for transferring your personal data out of the European Union. We do so through standard contractual clauses or through other safeguards when they are available.

 

B. Information provided on our Application

We also collect data relating to your visit to Maxen Connect. This information may include your IP address, the date, time and duration of your visits as well as the pages you consulted.

​

Our Application, like most other commercial SaaS applications, also uses cookies. These are files that are installed on your computer hard drive or web browser in order to collect information such as your language of preference, browsing history and browser type and version, all for the purpose of optimizing your experience on our Application.

These cookies cannot be used to extract personal information. However, we can match the information collected by cookies with other information through Maxen Connect. However, the information collected by cookies is not related to any other data that can identify you. Disabling cookies on your browser could adversely affect your browsing experience on Maxen Connect.

Finally, we may obtain personal information about you from third parties (e.g., Facebook, Twitter, Google) and use it to improve or re-market our Services, or to provide a more tailored experience with our Services. Technology is, by its nature, dynamic and ever-changing; the technological tools used today by Maxen Technology Inc. are therefore subject to modification and replacement in the future.

Use and Communication of your Personal Information

 

Maxen Technology Inc. will never sell or rent personal information to a third party. We will not use or share your information other than as described in this Privacy Policy unless it is under written direction from the individual.

We may use and disclose your personal information mainly to:

  • Improve and understand our Services

  • Communicate with you about the Services

  • Answer questions and information requests

  • Create and manage customers’ and end-users’ profiles

  • Fulfill customers’ and end-users’ requests

When we disclose your personal information to third parties, we take reasonable measures to ensure that the rules set forth in this policy are complied with.

 

Maxen Technology Inc. shares information with third-party service providers and agents who work on our behalf and provide us with services related to the purposes described in this Privacy Policy and our Terms of Service. These third-party service providers will have limited access to Customer’s personal data but only so much to do their job. A list of uses of data and third-party service providers is detailed below in appendices A and B.

 

Information about our customers is a business asset of Maxen Technology Inc. Consequently, information about you, including your personal data, may be disclosed as part of any financing round, merger or acquisition involving Maxen Technology Inc., the creation of a separate business to provide some or all the Services, the sale or pledge of Maxen Technology Inc.’s assets, as well as in the event of an insolvency, bankruptcy or receivership proceeding.

 

Notwithstanding anything to the contrary herein or in the Terms of Use, Maxen Technology Inc. may create derivative works based on the data collected from the Application for Maxen Technology Inc.’s internal business purposes, which may include the creation and commercialization of statistical and behavioral analyses, market trends, and other similar work product. If any such data contains your personal information, it shall have first been aggregated and anonymized in accordance with applicable industry standards (the “Aggregated Data”). Maxen Technology Inc. shall own all right, title and interest in the Aggregated Data and nothing in this Privacy Policy shall prohibit Maxen Technology Inc. or its affiliates from utilizing Aggregated Data for any purpose permitted under applicable law.

Legal grounds for processing (for individuals residing in European Economic Area (“EEA”))

If you are an individual residing in the EEA we can only process your personal data if we have a lawful ground to do so. Depending on the processing activity, we can process your personal data on the following grounds:

  1. In order to comply with our obligations under an agreement we concluded, for example for the provision of our Services;

  2. Where you have freely given your active explicit consent have not revoked this consent;

  3. Where we are pursuing a legitimate interest, which is not outweighed by your fundamental rights or freedoms;

  4. Pursuant to legal obligation under EU law or the law of a member state of the EU, or in very exceptional cases to protect your vital interests.

 

Right to Access and Correct

Any personal information gathered through Maxen Connect will be stored in a secure data center operated and managed by third party service providers. Maxen Technology Inc. owns and controls access to this infrastructure. Third rparty service providers do not access or process our data.

​

On written request and subject to proof of identity, you may request access to the personal information we have on file for you, request its deletion, or ask that any necessary corrections be made, where applicable, as authorized or required by law.

 

However, to make sure that the personal information we maintain about you is accurate and up to date, please inform us immediately of any change in your personal information.

 

Update

​

This Privacy Policy may be amended without notice. This policy was last updated on October 14th, 2020.

 

Data Retention

 

Maxen Technology Inc. will retain your data as part of the service provided as long as you are a Customer of Maxen Connect. A Customer ceases to be a Customer on the date of expiry of their account and/or last paid invoice. Your personal information will be securely removed from Maxen Connect servers 90 days after this date, or will be aggregated and anonymized pursuant to applicable industry standards.

 

Customers will be able to export their data during this time. Customers can request Maxen Technology Inc. to continue to store their data at their specified subscription cost.

 

Maxen Technology Inc. may retain your data to the extent necessary to comply with our legal obligations. Customers can update their information, terminate their account, or remove their personal information at any time by contacting us. Our contact information is detailed below.

Maxen Technology Inc. is located in Montreal, Canada. All data may be stored in Canada or in the United States.

 

Security

 

Maxen Technology Inc. views the security of all personal information as a priority. We have internal policies that keep your data private and confidential. Maxen Technology Inc. also uses many safeguards to protect the personal information submitted to us, both during transmission and once we receive it. Maxen Technology Inc. securely transmits and stores all data to the best standards and practices of the industry. All sensitive information (such as credit card data) is encrypted, transmitted and stored in a secure way. However, no computer system, method of transmission, or method of electronic storage can ever be fully protected from every possible threat. Therefore, while Maxen Technology Inc. takes measures to ensure the security of online transmission and storage of all data offline to the best standards and practices of the industry, we cannot guarantee its absolute security. We will let you know promptly if a breach occurs that may have compromised the security of your information.

There are some instances where it may be necessary to disclose information collected. Maxen Technology Inc. reserves the right to disclose information to:

Appendix A – Usage of personal data

 

All personal information collected regarding Maxen Connect users is under the direction and discretion of the Maxen Connect customer.

Field Name: Description

 

  • First & Last Name: Required as a parameter in Maxen Connect features

  • Address Information: Optional

  • Email Address: Required for account activation and password recovery.

  • Birth Date: Optional. May be used for additional security to login to Maxen Connect.

  • Password: Used to login to Maxen Connect. Encrypted (irreversibly)

  • IP Address: Required for account activation and for regular use of the Services

  • Geolocation Data (excluding nationality): May be obtained during account activation process and in connection with regular use of the Services

  • Bank Account or Credit Card Details: Required for account activation and payment of Services

Appendix B – Third-party processors

Amazon Web Services (AWS): AWS is responsible for the operation, management, and control of the components from the host operating system and virtualization as well as physical security of the physical infrastructure including servers, network, and data center. Maxen Technology Inc. owns and controls access to this infrastructure as well as data stored on this infrastructure. AWS does not access or process our data other than storing and transmitting encrypted data.

FreshWorks: FreshWorks is a platform that provides managed services to support businesses core processes. Maxen Technology Inc. uses FreshWorks products that are all GDPR-compliant. FreshDesk, FreshChat and FreshCaller are used to help customer service requests sent through email, online chat, the online support form or via phone call. Personal information such as first name, last name, email, email content, phone number and recorded conversations are collected for support purposes only.
